Car Runs Stop Sign and Crashes into MBTA Bus in Dedham

The driver of a car was cited on Tuesday for failing to stop at a stop sign on Providence Highway and as a result caused a crash with a Route 34E bus in Dedham. The Massachusetts Bay Transportation Authority reported that six people were injured in the car and bus crash. Five people on the bus were taken to hospitals in the area with back injuries. The 19-year-old driver of the car was taken to Norwood Hospital with a back injury.

Although the accident is still under investigation, MBTA spokeswoman Lydia Rivera reported that the bus was damaged on the right side and that the car was dented at the front.

The MBTA website provides passengers with emergency safety information and recommendations in the case of an emergency or accident. For bus transit emergencies, MBTA recommends to:

• Remain calm and to follow the instructions of the driver
• Know where the emergency exits are located
• Only exit the bus when the driver says it is safe to evacuate
• Sit close to the bus driver at the front of the bus during off-hours
• If you are medically qualified and capable of helping in an emergency, identify yourself to the driver or Transit Police
• Notify the bus driver of any trouble or suspicious activity on the bus. The driver can radio the dispatcher and notify the MBTA Transit Police Department.

UConn Student from Westminster, Massachusetts, Killed by Campus Shuttle Bus

On Tuesday night, a University of Connecticut shuttle bus struck and killed a student from Westminster, Massachusetts at an intersection on campus. The UConn student, 20-year-old David N. Plamondon, was living off campus. The bus hit Plamondon in the intersection of Hillside Road and Alumni Drive by the North Parking Garage on campus at approximately 8:15 p.m. A witness of the fatal accident immediately called the campus police. Campus police arrived at the scene of the accident with emergency crews and administered first aid but could not save him as his injuries were so severe. Although the cause of the accident is unknown and the case is under investigation, a medical examiner will determine the cause of the Plamondon’s death.

Major Ronald Blicher, of the UConn Police, said, "There were witnesses to the accident…They are being interviewed by police…The bus driver is being interviewed by police." Police do not believe that the UConn women’s basketball game on campus was related to this accident or that the victim had been to the game. No charges have been filed yet.

Pedestrians, bicyclists, and drivers should always use extra caution on campuses and especially after dark. On Boston University’s campus website, students are reminded of the following pedestrian safety tips:

• Be careful when crossing streets and tracks.
• Always use pedestrian crosswalks.
• Look left and right for cars, bikes, and trolleys before crossing the street.
• Always be alert when using personal electronic devices.
• Walk in well-lit areas at night.
• Use an escort security service or walk with a friend to your destination.

If you or your loved one has been injured or killed in an accident, please feel free to contact one of our Massachusetts traffic fatality lawyers who can help you with their 25 years of experience.

Cape Cod Man Killed by a Bus, Charges Not Likely

A Yarmouth Port man died on Sunday after he reportedly walked in front of a bus at Walt Disney World’s Port Orleans resort. Witnesses say the 69-year-old Massachusetts man stepped into the path of a Disney bus traveling through the parking lot of the resort. A report states that the front of the bus hit the accident victim and knocked him to the ground. He later died at Orlando Regional Medical Center.

The bus accident occurred around 5:50pm, according to the Florida Highway Patrol.

The bus was driven by a 57-year-old woman who says she’s not sure how many passengers were in the bus at the time of the accident. No passenger injuries were reported. The man was not in a crosswalk, and the highway patrol says the bus had the right-of-way, so it’s unlikely that any charges will be filed in connection with the fatal pedestrian accident. The incident remains under investigation.

Earlier this year, a Disney bus struck and killed a boy who was riding his bike through Disney’s Fort Wilderness Resort campground. The highway patrol said the accident may have been caused by the lack of air in the bike tires.

UMass Bus Crash Injures 16 Students

According to an article in the Boston Herald, a bus crash last Friday injured 16 University of Massachusetts at Amherst students who were en route to Canada for a ski trip. The bus driver sustained head injuries and some internal injuries but was listed in stable condition at Darthmouth-Hitchcock Medical Center on Monday.

State police said the bus driver apparently had a pre-existing heart condition, but it’s unclear if that was a factor in Friday’s bus crash. They added that the driver has shown no signs of taking evasive action. They are still investigating the bus accident.

Depending on the circumstances of the accident, there are several parties who can be found at fault for injuries from a bus accident. These include the bus company, bus maintenance companies, bus manufacturers, the bus driver, and drivers of other vehicles.

Bus Carrying UMass Students Flips Over in Vermont

A bus carrying UMass Amherst students on a ski trip to Canada crashed on a Vermont highway Friday. The crash happened when the 49-year-old bus driver lost consciousness. According to owner of bus company, Tour World, the driver felt a tingling and started to pull over, but it was too late.

The bus was carrying 44 passengers when it swerved across the I-91 median into an embankment and flipped onto its side. Sixteen of the student passengers were treated for injuries including concussions, wounds and back injuries. Four of them were taken to the emergency room for critical injuries.

According to the bus company owner, the driver had no known medical conditions and passed a physical 6 months ago. He was hospitalized overnight at Dartmouth-Hitchcock Medical Center in New Hampshire.

The ski trip was organized by a private group, but UMass sent university vehicles to the scene to transport students back to campus. Some of the students continued on to Canada.

The driver and passengers are fortunate that no one was killed in this accident. More than 250 people are killed and more than 15,000 people are injured every year in bus accidents like this one. Although the media has said that no serious injuries have been reported yet, concussions, like all other head injuries, are very serious. Sometimes it can take weeks for a doctor to recognize a traumatic brain injury, and repeat concussions can lead to devastating consequences. So the risks are amplified here, given the fact that some of these students may have suffered concussions and went on to ski where they could suffer more blows to the head.

It is unclear whether anyone could be held responsible for injuries suffered from this accident. It seems that the driver may have been driving carefully and suffered an unexpected heart attack, but an experienced personal injury lawyer could look into all of the facts and circumstances and assess your case.

Woman Struck and Killed by Lowell Bus

Judyann Lamothe, a 53-year-old Lowell woman, was killed last Thursday when she was hit by a bus. Lamothe fell under the wheels of a Lowell Regional Transit Authority shuttle as it moved out from a bus stop in downtown Lowell, according to the Boston Globe.

An administrator from the LRTA said the bus driver had a good driving record and had been with company for 13 years. The administrator also said that the accident happened as Lamothe was banging on the back of the bus, trying to get on as it was driving forward, but that the driver didn’t hear her. He said that that was when she fell underneath the back wheel. Police are still investigating the accident.

Bus accidents can be the result of many different factors including driver error and inattention, bad weather, malfunctioning equipment, poor maintenance and dangerous traffic conditions. In certain circumstances, the person injured might be entitled to compensation for their injuries.

Massachusetts Bus Driver Charged with Negligence Following Accident

A Rehoboth school bus driver who was involved in a traffic accident in September 15 has been charged with negligent driving after she allegedly “dozed off” before her vehicle hit a tree, injuring the driver and a 10-year-old student. The driver was placed on leave following the accident. She will be summoned to Taunton District Court, but no date has been set.

In the event of a bus accident or other emergency, Rehoboth school bus drivers are told to call police and fire officials before notifying the bus company. The school superintendent said she and the police and fire chiefs are working to improve bus safety and communication between bus drivers and schools.

Here in Massachusetts, driving negligently is a misdemeanor. Junior operators who are convicted of driving negligently or recklessly are subject to up to a 60 day revocation of their driver’s license. A subsequent conviction within three years can result in a one year suspension.

Longmeadow Bus Stops for Pedestrian, Injures Passengers

On Tuesday morning, a Western Massachusetts school bus accident injured seven children when the bus was rear-ended by another vehicle. The traffic accident occurred around 8:30am in the town of Longmeadow.

According to the Longmeadow police lieutenant, the bus was en route to Curtis Blake Day School in Springfield and had stopped at a red light on Converse Street, then began to move again when it stopped suddenly to avoid hitting a pedestrian still in the crosswalk. The vehicle behind the bus rear-ended it. The bus driver and the people in the car were not injured, but all seven children were taken to Bay State Medical Center to be treated for minor injuries.

According to the Massachusetts Office of Health and Human Services, almost half a million Massachusetts students ride school buses each year and accidents are rare. Most bus-related injuries occur with pedestrians who are entering or exiting the bus.

Massachusetts Injury Attorneys Discuss School Bus Safety

Currently, several states require should safety states require school buses to have shoulder safety belts, but Massachusetts is not among them. According to the Registry of Motor Vehicles, there were 1,730 school bus accidents reported in the Commonwealth in 2008, and almost a thousand more reported in 2009. The state has roughly 9,000 school buses registered.

Though Massachusetts recently passed a bill banning texting while driving and requiring older drivers to pass more frequent testing, legislators have overlooked this safety loophole. A school safety belt law was presented and killed in the United States’ Transportation Committee back in 2008. This year, the Public Safety Committee has recommended that Congress pass the bill. It’s currently in the House Committee awaiting a recommendation before going to a full House vote.

Unfortunately, many lawmakers are not familiar with the bill and there seems to be limited momentum for getting the bill passed.

Bus Accident Highlights Metro Safety Issues

Here in Boston, we've had our share of subway and bus accidents. Apparently, we aren't the only city with this problem. On Friday afternoon, bus riders in Washington, DC boarded the B2 bus as usual, not knowing that the driver was an imposter. The 19-year-old man donned a standard-issue Metro bus driver’s uniform and drove a bus out of the Bladensburg garage before picking up passengers and crashing the vehicle into a tree and multiple cars.

The bus accident has resulted in an in-depth review of the Metro’s security procedures to determine how an unauthorized person could have driven a bus out of the garage.

Initially, the bus driver fled, but he was later arrested and charged with unauthorized use of a vehicle and fleeing an accident. He reportedly told investigators that he simply had a fascination with buses.

Bicyclist Hit, Killed in MBTA Bus Accident

On Wednesday evening, a bus accident near the intersection of South Huntington and Huntington Avenues killed a 23-year-old bicyclist. According to reports, the man's bicycle had gotten stuck in the Green Line trolley tracks and he was hit by a Route 39 bus while trying to free it. The MBTA bus accident victim was transported to a local hospital, where he was later pronounced dead.

Witnesses say the accident happened so quickly that neither the bicyclist nor the bus driver had time to react. The driver, who is 29-year-old and has no record of safety or traffic violations, had about 150 feet to react.

As a result of the fatal bus accident, police down shut Huntington Avenue and other streets in the surrounding area so that accident reconstruction teams could investigate. Passengers on the E line rode buses between the Brigham Circle and Heath Street stations, as Green Line service was temporarily suspended.

Massachusetts Residents Among the Victims of Bus Crash

On Monday afternoon, a tour bus accident in Florida killed two people and injured several others. The tour group is based out of Boston and three Massachusetts residents are believed to be among the bus crash victims, although authorities have not released the names of those killed.

All but one of the people on the bus were transported to local hospitals. The passengers ranged in age from 66 to 87.

A Florida Highway Patrol crash report states that an 81-year-old woman in a Mercury Sable failed to yield right of the bus and the vehicles crashed into each other. The bus apparently rolled over twice before it landed on its side. The driver of the Sable was not injured. As of last night, no charges had been filed in conjunction with the roadway accident.

Texting Ban for Truckers and Bus Drivers Announced

Here in Massachusetts and around the country, safety advocates have been calling for a ban on text messaging while driving, which has been proven to increase the likelihood of an auto crash. On Tuesday, the Transportation Department unveiled its new rule that bans interstate commercial truck and bus drivers from text messaging while driving. Those who violate the rule will be subject to civil or criminal fines up to $2,750.

According to the National Safety Council, text messaging and other cell phone-related activities cause more 1.6 million traffic accidents every year.

The department is working on new rules that cut down on the use of dashboard-mounted computers that some drivers use to communicate with dispatchers. While some companies discourage drivers from using such computers, many truckers still use the devices regularly. The department is also working on regulations that would govern when truckers are permitted to use cell phones for conversation.

Weezer Injured in Bus Crash, Cancels Boston Concert Date

Earlier this week, a bus crash injured Weezer frontman River Cuomo and his assistant as they were traveling to a concert scheduled for Monday night at Boston's Agganis Arena. The tour bus reportedly hit a patch of ice and crashed into a ditch. According to one news source, Cuomo sustained injuries including three cracked ribs and some "painful internal damage."

Emergency response crews had to use the Jaws of Life to rescue him from the wreckage, but a friend of the band said he is now resting as comfortably as could be expected. Cuomo's assistant Sarah Kim fractured two ribs and a lower vertebrae. His wife and daughter, who were also traveling on the tour bus, were not injured.

In response to the bus accident, Weezer has canceled the rest of its December tour dates, including the Monday night concert in Boston. However, the band hopes to reschedule once Cuomo recovers, and Agganis Arena is advising ticket holders to keep tickets until a new date is announced.

"Operation Yellow Blitz" Nabs 76 Massachusetts Drivers

Last week, police and registry inspectors caught at least 76 Massachusetts drivers for allegedly failing to stop for school buses picking up or dropping off student passengers. The annual event has been called "Operation Yellow Blitz" and is aimed at reminding those drivers that they must stop when a bus's flashing red light goes on.

The Registry of Motor Vehicles fields thousands of complaints from police, school bus drivers, and parents about drivers who fail to stop for a school bus, creating a safety issue on the road. First-time offenders face a $250 citation. Those who receive a second violation within two years face a $1,000 fine and a six-month driver's license suspension.

Last year, 60 Massachusetts communities set up surveillance teams for Operation Yellow Blitz, resulting in citations for 69 drivers.

Camera on MBTA Bus Captures Holbrook Accident

Last Monday, an accident in Holbrook involving an MBTA bus and another car was captured on one of the bus' cameras, helping transit police determine who was at fault for the bus accident.

Last week, the MBTA released the video, which shows the driver of a Chevy Malibu slumping over before crossing the median line and hitting the MBTA bus head-on. The footage helped police determine that the bus driver was not at fault for the motor vehicle accident. They cited the other driver for failure to stay within marked lanes.

Police say that surveillance video footage has also helped them in other instances, like when a crime is committed on an MBTA bus or nearby or when suspects ride the MBTA after committing a crime. Roughly 350 buses out of the MBTA's 1,100-bus fleet are outfitted with eight cameras each. Some subway cars and stations also have video cameras.

In Wrentham, Dump Truck Slams Into Bus, Injures Several Kids

On Tuesday afternoon, a dump truck hit a school bus head on. The truck driver reportedly told police his brakes had given out, so he attempted to swerve around a line of stooped cars and slammed into the bus, which was stopped to let students unload. Several students cut their lips or suffered bumps and bruises in the bus accident. Fortunately, there were no serious injuries.

Asphalt in the truck bed went flying onto the bus and onto the road. The owner of a nearby auto repair shop pried open the driver's door for fear that the truck would catch fire. He said the driver was semi-conscious and the brakes were to the floor. The truck driver was transported to Caritas Norwood Hospital with cuts on his face.

Wrentham police are still investigating the head-on collision and will determine whether to issue a ticket to the truck driver.

Court Rules in Favor of Family of Foxboro Bus Accident Victim

Last month, Massachusetts' highest court upheld a $4.4 million award to the family of a man who died in a bus accident involving a large security gate arm that hit a bus transporting spectators between a golf tournament and Foxboro's Gillette Stadium.

The tragic bus crash occurred in 2003 and killed a 64-year-old Yarmouth man. Five more people injured in the bus accident.

Although the judge violated a mandate not to allow jurors to discuss the case among themselves before deliberation, the state Supreme Judicial Court upheld the original ruling, saying the judge's error did not prejudice the companies being sued.
